When The Football Regulatory Database first launched on Substack in the summer of 2025, the objective was simple: make football law more accessible.

The idea itself began earlier.

In 2023, after launching Pitchside Sports Consulting in Toronto, I began reflecting on the legal, economic, and institutional gaps that continued to hold back professional football development across North America, Central America, and the Caribbean.

At that point, I had recently completed my work as the first lawyer to the World Leagues Association, one of global football’s most relevant stakeholder bodies, representing more than 45 professional leagues from around the world. That experience placed me in rooms with league executives from the Premier League, LaLiga, Bundesliga, MLS, Saudi Pro League, Eredivisie, Ligue 1, Swiss Football League, South Africa, Nigeria, Japan, Korea, Australia, and beyond.

It helped me understand something important.

Football regulation is not an abstract legal field.

It is the operating system behind the professional game.

It shapes how leagues professionalize, how clubs transfer players, how players enforce their rights, how agents advise clients, how federations and arbitration centres build dispute systems, and how local football economies connect to the global football market.

That understanding was reinforced through my work on FIFA Football Tribunal and Court of Arbitration for Sport matters, where I saw football law operate in practice as a specialized legal field with substantial casework, technical nuance, and professional opportunity. What I experienced first-hand was football law in practice. Not theory. Not general sports law. A specialized legal system with its own procedures, institutions, disputes, economic consequences, and growing relevance for stakeholders who understand how to navigate it.

In this region, sports law certainly exists, but often not in the way it is understood within the global football legal order.

Much of the local market still treats “sports law” as the application of general domestic legal services to people or businesses with some connection to sport. Tax, employment, immigration, investment, corporate structuring, commercial contracts, and stadium-related advisory work all have a place in the sports industry.

While other firms may apply general legal services to stakeholders with some connection to sport, Pitchside Sports Consulting is focused on the football-specific regulatory system itself: FIFA regulations, League regulations, club transfer strategy, player status, training rewards, contractual stability, dispute resolution, and the institutions that govern the global game.

That was the gap we were seeing.

That is law applied to sport.

It is not the same as understanding football law as lex sportiva, with its own regulatory architecture, procedures, institutions, jurisprudence, and commercial consequences.

Too few stakeholders understood the FIFA regulatory system, player status rules, training compensation, solidarity, international transfers, contractual disputes, or football-specific dispute resolution, which creates a significant economic disparity in how our region develops football from the top down.

This is the capacity, institutional, and economic gap I have seen first-hand in practice, and it is the gap this article seeks to explain to our audience.

It began through articles, case commentary, regulatory breakdowns, webinars, and practical analysis for lawyers, law firms, consultants, arbitrators, clubs, leagues, players’ unions, federations, agents, students, and the wider football stakeholder community.

Substack became the foundation, as it will continue to be.

Free articles will continue to be available on Substack. Paid subscribers will continue to receive deeper football-regulatory insights, webinars, standardized templates and practical commentary through the platform. Substack remains the publication and community layer of this work.

But the project has now reached a stage where it requires more than one platform.

That is why we have launched:

The new website is not a replacement for Substack.

It is an expansion.

The difference is structure.

The independent platform allows us to organize the work more clearly across publications, education, intelligence, membership, templates, webinars, and football-regulatory resources. It gives The Football Regulatory Database a home that can grow beyond the limits of a single publishing platform while still linking back to the Substack archive that helped build the foundation.

This next step also reflects the level of interest the project has received.

The Football Regulatory Database has grown from an idea supported through crowd-sourced engagement here on Substack, alongside the growing list of subscribers who follow and support our work, into something much larger.

Over the last year, that support has expanded across Substack and LinkedIn, growing into a wider community of readers, subscribers, and paid members. Those paid members now include coaches, law firms, players’ unions, agents, and other stakeholders across the football ecosystem.

From there, the project has also attracted private interest from legal stakeholders across North America, Central America, and the Caribbean who have used our insights as a tool to develop their own practices, strengthen their understanding of international football law, and better understand the regulatory system shaping the global game.

Many have used our insights not simply as content, but as a practical tool to develop their own understanding of international football law and to strengthen their own professional practices.

This platform is also part of our reinvestment commitment.

The Football Regulatory Database did not enter this field to make millions of dollars from football law. I entered it because there are clear legal, economic, and capacity gaps across this region. Those gaps affect how clubs understand the transfer system, how players and their respective unions enforce their rights, how agents advise clients, how federations build dispute resolution systems, and how legal professionals develop credible football-specific practices.

The Football Regulatory Database exists to help fill that gap.

Through the new website, the work is now organized around four core areas:

Publications — The Football Regulatory Database articles, Substack commentary, external contributions, and independent football-regulatory publications.

Education — webinars, templates, and practical tools for football stakeholders.

Intelligence — FIFA Football Tribunal matters, CAS jurisprudence, NDRC development, confederation issues, and regional regulatory insights.

Membership — deeper access for paid members, legal stakeholders, institutional users, and football professionals.

This is what is different.

The Football Regulatory Database is no longer only a publication.

It is becoming a football-regulatory platform.

The goal is not simply to publish more content. The goal is to build durable football-regulatory infrastructure for stakeholders who want to understand, participate in, and eventually help shape the global football legal order.

The two rulings analyzed below rendered from the Court of Justice of the European Union (e.g., CJEU) do not abolish FIFA’s authority to regulate agents. They establish that this authority is legally conditional and must be exercised in compliance with EU law, which may also be relevant for other less developed regions shaping the future of agent related market behaviour as agents activity is seen globally, not just i Europe.

1. What the FFAR are and why they matter

The FIFA Football Agent Regulations govern agent activity connected to the international transfer system governed by, among other FIFA regulatory frameworks, the FIFA Regulations on the Status and Transfer of Players. They regulate who may act as a football agent in the context of international transfers, how agents may represent clients by establishing standards for representation agreements, how agents may be remunerated through commissions and which applicable fee caps must be considered, what information agents must disclose concerning their activities, and which FIFA bodies may supervise or sanction their conduct. The current edition entered into force on 1 January 2025.

The FFAR pursue objectives including:

• Minimum professional and ethical standards governing agent activity;

• Regulatory protection for players, clubs, coaches, and agents;

• Mitigation of conflicts of interest, including through the regulation of relevant global issues such as dual representation;

• Financial and administrative transparency in agent-related economic and transfer activity;

• Contractual stability across agreements between relevant stakeholders, including player-agent representation agreements, club-agent commission structures, and club-club transfer agreements;

• Protection against abusive or speculative conduct; and

• Improved integrity of the international transfer system.

The regulations matter because FIFA is not merely issuing professional guidance through the FFAR. This newly developed regulatory ecosystem controls the legal and institutional gateway through which international agent activity occurs.

A person generally requires a FIFA licence to perform football-agent services, must comply with FIFA’s rules, and may be investigated or sanctioned within FIFA’s regulatory structure.

The FFAR therefore directly affect:

• access to the profession through the licensing and annual renewal process;

• the commercial model of agencies;

• agents’ contractual and economic freedom;

• player and club choice;

• commission structures;

• confidentiality and personal data;

• cross-border service provision; and

• competition within the agent market.

For these reasons, the FFAR is an important regulatory tool for increasing transparency and integrity within the global transfer system. Its significance is particularly unique because, while clubs, players, coaches, and member associations operate within football’s established institutional structure, agents often sit outside that structure despite being inherent to the functioning of the transfer market. This is precisely why the FFAR must be properly understood and, in many cases, requires specialist expertise within the already niche legal practice of football law, itself a specialized field within international sports law.

2. The basic legal position after the two judgments

In light of recent judgments rendered by the Court of Justice of the European Union, it is important to understand where these developments leave football agents, how their activities are currently regulated, and what they may mean for the future of professional football law.

To understand this clearly, two recent CJEU judgments must be read together:

C-428/23, ROGON

The Court held that a sports federation may, in principle, regulate the use by its members of services supplied by third parties such as agents.

The fact that agents are not members of the federation does not automatically prevent the rules from being justified under the Wouters and Meca-Medina framework. Regulation may be necessary because clubs, players, federations and agents form part of an interconnected football ecosystem.

However, the rules remain subject to Article 101 TFEU. They must pursue a legitimate objective and be appropriate, necessary and proportionate. The national court must carry out that assessment.

C-209/23, RRC Sports

In the second case rendered by the CJEU, the Court examined central FFAR mechanisms more directly.

The Court held that FIFA may be regarded as occupying a dominant position, within the meaning of Article 102 TFEU, in the market for agent services relating to the international transfer of professional players and coaches, as well as in the connected employment markets for players and coaches.

That position arises from the regulatory, supervisory and sanctioning powers FIFA exercises over those markets. However, it remains for the referring national court to determine whether the contested rules constitute an abuse of those dominant positions and, where relevant, whether they may be objectively justified.

The Court also identified several rules as potentially restricting competition or constituting obstacles to the freedom to provide services, while recognizing that certain restrictions may be justified by legitimate objectives in the public interest.

It was particularly critical of the rule preventing an agent from approaching or concluding a representation agreement with a client already bound by an exclusive agreement outside the two-month period preceding its expiry, finding that rule incompatible with Article 101 TFEU because it places independent agents at a competitive disadvantage. The Court further held that the GDPR precludes the disclosure and publication by FIFA of sanctions imposed on agents or their clients, as well as detailed information concerning all transactions involving agents.

3. Representation agreements

Article 12 FFAR requires a written representation agreement before an agent may provide agent services. Agreements with players or coaches may not exceed two years and may not contain automatic renewal provisions. Only one representation agreement may exist between the same agent and individual (e.g., player or club) at the same time. The agent must also advise the individual in writing to consider independent legal advice.

These requirements serve legitimate objectives:

• contractual clarity;

• informed consent;

• prevention of indefinite exclusivity;

• protection of inexperienced players such as minors; and

• reduction of disputes.

The EU-law difficulty is not not principally grounded in requiring written agreements or limiting their duration. It becomes relevant when the regulatory framework protects the acting agent beyond what is necessary.

The two-month approach rule prevents another agent from approaching or contracting with a client bound by an exclusive agreement until the final two months. The CJEU considered that this appears incompatible with Article 101 TFEU because the incumbent agent may renegotiate or renew before that window while competitors remain excluded.

That creates a market asymmetry contrary to the fundamental principle of free movement.

The problem is not protection of contractual stability in itself. The problem is that the rule may go beyond preventing inducement of breach and instead shield incumbent agents from open competition.

A more proportionate system in the future FFAR could distinguish between:

• inducing a client to breach an existing agreement;

• discussing future representation;

• entering into a new agreement that takes effect only after expiry of the former; and

• improperly interfering with an active mandate.

The current rule does not sufficiently distinguish between those categories, leaving clear scope for a more precise and effective approach in any future revision of the FFAR.

4. Licensing process

The FFAR require a natural person to apply through FIFA’s Agent platform, satisfy the applicable eligibility requirements, pass the football agent examination, and pay an annual licence fee. Licensed agents must also comply with continuing professional development and ongoing reporting obligations to remain informed of the regulatory requirements that may affect their conduct and market activity.

Licensing is legally defensible in principle. The CJEU accepted that it may serve legitimate objectives such as ethical standards, competence, client protection and integrity.

Article 5 contains broad exclusion criteria based on criminal convictions, disciplinary measures, insolvency, employment relationships and ownership interests. Some exclusions may be clearly connected to professional fitness. Others may be too absolute, insufficiently time-limited or disconnected from the actual risk posed by the individual.

The relevant questions under EU law include:

• Is the exclusion linked to the person’s present fitness to act as an agent?

• Is the rule limited in time?

• Does it distinguish serious misconduct from minor or remote misconduct?

• Is there an individual assessment?

• Is there an appeal mechanism?

• Could a less restrictive measure achieve the same objective?

The CJEU did not hold that FIFA licensing is unlawful. It held that licensing restrictions are obstacles to the freedom to provide services and therefore require proper justification.

The issue going forward is not whether the licensing system will survive, but whether its eligibility framework is sufficiently precise, reviewable, and proportionate to satisfy the requirements of free movement under EU law.

5. Dual and multiple representation

Article 12 permits one form of dual representation: an agent may represent the player or coach and the engaging entity in the same transaction where both give prior written consent.

In general terms, the FFAR prohibits dual representation of:

• the releasing club and the player;

• the releasing club and the engaging club; or

• all parties to the same transaction.

Connected agents are also prevented from representing different clients in the same transaction outside the permitted exception.

FIFA’s objective is conflict prevention. That objective is legally legitimate.

The EU-law problem is whether the prohibition is calibrated to actual conflicts or imposed as a broad market restriction.

A complete prohibition may reduce conflicts, but it also:

• limits agents’ commercial activity;

• reduces client choice;

• disadvantages multi-service agencies;

• may increase transaction costs;

• may affect smaller agencies disproportionately; and

• may restrict cross-border service provision.

The CJEU held that the restrictions on multiple representation constitute obstacles to the freedom to provide services under Article 56 TFEU. However, because the matter reached the CJEU through the preliminary-ruling procedure, it remains for the referring German court to determine whether those restrictions may be justified by legitimate public-interest objectives and whether they are suitable, necessary, and proportionate to achieving those objectives.

The critical proportionality question is whether conflicts can be managed through less restrictive means, such as:

• informed consent;

• mandatory disclosure;

• separate teams within an agency;

• independent legal advice;

• conflict waivers;

• transaction-specific safeguards; or

• prohibition only where interests are irreconcilable.

In this context, FIFA must demonstrate why the chosen prohibition is necessary rather than merely administratively convenient.

6. GDPR and data protection

The FFAR impose extensive reporting obligations for licensed agents, which is also something new to the FFAR itself. Agents must upload representation agreements, other service agreements, fee information, agency ownership information, cooperation arrangements, settlements and other regulatory information to FIFA’s Agent platform.

Article 19 then requires FIFA to make available:

• agents’ names and details;

• their clients;

• exclusivity status and expiry dates;

• services provided;

• sanctions; and

• details of transactions, including agent fees.

The CJEU drew an important distinction between regulatory processing and public disclosure.

FIFA may have legitimate reasons to collect and process information for compliance, supervision and disciplinary purposes.

However, the Court held that the GDPR precludes disclosure and publication of every sanction and detailed information on all transactions involving agents.

The principal defects are:

• over-breadth;

• lack of disctinction between regulatory necessity and public accessibility;

• insufficient data minimisation;

• potential disclosure of commercially sensitive information;

• reputational harm;

• insufficient regard to retention periods and procedural status; and

• possible disclosure before remedies or appeals are exhausted.

In any future revision of the FFAR, a lawful model may permit FIFA to collect detailed information internally while limiting publication to aggregated, anonymized, or strictly necessary data. Article 19 is therefore among the FFAR provisions most clearly requiring revision in light of applicable data protection laws. This also raises an important question as to how the provision can be applied consistently across jurisdictions in which data protection standards differ significantly.

7. Approaching players and clients

The FFAR define “Approach” broadly. It includes direct contact, electronic contact, indirect contact through family or associates, and contact through another person.

This broad definition is combined with Article 16’s two-month restriction.

FIFA can legitimately prevent:

• inducement of contractual breach;

• harassment;

• improper solicitation of minors;

• exploitation of vulnerable players; and

• undisclosed interference with an existing representation relationship.

However, the existing approach rule may suppress lawful competition rather than merely prevent misconduct, particularly given the fundamental freedom to provide services under EU Internal Market Law.

The CJEU identified an unequal competitive effect: incumbent agents can renegotiate with the client while prospective agents remain excluded from engaging.

This is significant because the rule may:

• entrench established agents;

• reduce players’ access to alternative advice from smaller agents;

• suppress fee competition;

• weaken service competition;

• make poor representation harder to escape; and

• restrict agents seeking to enter new markets.

The likely regulatory direction is toward a narrower anti-inducement rule rather than a broad prohibition on contact.

8. Salary thresholds and commission caps

Article 15 of the current FFAR provides different commission caps depending on whether the player’s annual remuneration is above or below USD 200,000.

For an individual or engaging club, the cap is generally:

• 5% below or at USD 200,000;

• 3% above that level.

For permitted dual representation:

• 10% below or at USD 200,000;

• 6% above that level.

For a releasing club, the cap is 10% of transfer compensation.

This structure raises a number of legal and economic concerns under EU law, which formed part of the basis for the proceedings before the Dortmund Regional Court and the related preliminary reference to the CJEU.

Following the German injunction, FIFA announced on 30 December 2023 the worldwide temporary suspension of the FFAR provisions affected by that decision, significantly limiting the operation and enforcement of the new regulatory framework, including the newly established dispute-resolution system intended to operate through the Agents Chamber of the Football Tribunal.

The salary-gap problem

The use of a uniform USD 200,000 threshold assumes a degree of global market comparability that does not exist.

USD 200,000 has radically different significance across:

• elite European leagues;

• lower divisions;

• women’s football;

• African, Caribbean and Central American markets;

• developing professional leagues;

• youth transitions;

• short-term contracts; and

• coaching markets.

The threshold may therefore produce arbitrary effects.

An agent representing a lower-paid player may receive a higher percentage but a very low absolute amount. That may make representation economically unviable, particularly where the matter involves relocation, immigration, tax, disciplinary or contractual work.

Conversely, the cap may materially reduce earnings on high-value transactions even where the agent has performed extensive work or assumed substantial risk.

The legal issue under Article 101 is whether FIFA is effectively fixing the price of agent services.

The CJEU did not invalidate the cap. It left its justification to the interpretation of the national court.

FIFA’s statement is therefore technically correct that the cap “can be justified,” but that is not equivalent to a finding that the current percentages and threshold are lawful.

9. Article 101 TFEU

Article 101 TFEU prohibits agreements between undertakings and decisions by associations of undertakings that have as their object or effect the prevention, restriction, or distortion of competition within the EU internal market.

The CJEU confirmed that rules governing football-agent activity may fall within Article 101 because agent services constitute an economic activity and the rules may affect competition in the markets for agent services and the recruitment of professional players and coaches. FIFA’s regulatory decisions may therefore be assessed as decisions of an association of undertakings for the purposes of EU competition law.

Under the Meca-Medina framework, a restriction that does not have an anticompetitive object may nevertheless fall outside the prohibition in Article 101(1) where it pursues a legitimate public-interest objective and the restrictive effects are inherent in, and proportionate to, the pursuit of that objective. This assessment must be conducted concretely and cannot be satisfied merely by identifying a broadly desirable regulatory purpose.

Accordingly, FIFA must be able to demonstrate:

• the specific risk or market failure the rule is intended to address;

• a genuine connection between the restriction and that clearly identified risk;

• that the restriction is suitable for achieving the stated objective;

• that it does not go beyond what is necessary, including whether a less restrictive alternative is available; and

• that its practical operation remains proportionate.

The ultimate assessment of those factors, insofar as it depends on the facts and effects of the contested rules, remains for the referring national court.

10. FIFA’s position

FIFA has framed the judgment as confirmation that:

• it has authority to regulate agents;

• licensing may be justified;

• fee caps may be justified;

• multiple-representation restrictions may be justified;

• client-pays rules may be justified; and

• pro rata payment rules may be justified.

However, FIFA’s language risks overstating the outcome. The Court did not definitively approve those provisions. It held that they are capable of justification, subject to national judicial review.

FIFA’s most important practical statement is its intention to invite representatives of the agent industry to discussions aimed at reaching a consensual solution. Much like the revised FIFA Regulations on the Status and Transfer of Players, which will enter into force on 1 January 2027 following consultation with key football stakeholders, this indicates that FIFA recognizes the need to reconsider aspects of the existing FFAR framework before the new global transfer system becomes operational. A coordinated approach would also be important to ensuring regulatory coherence and greater predictability in the practical application of the RSTP and FFAR from 2027 onward.

11. EFAA’s position

The European Football Agents Association (EFAA), a non-profit representative body comprising national agent associations in Europe, affiliated associations outside Europe, and individual agents across numerous jurisdictions, treats the ruling as validation of agents’ long-standing concerns regarding the legality, proportionality, and practical effects of the FFAR.

EFAA represents the collective interests of the football-agent profession in its engagement with FIFA, European institutions, and other professional football stakeholders.

EFAA’s strongest legal points concern:

• the two-month approach rule;

• Article 19 publication;

• FIFA’s possible dominance;

• the need for evidence-based proportionality; and

• the distinction between legitimate objectives and lawful measures.

The two institutional narratives therefore reflect different aspects of the judgment: FIFA emphasizes the legitimacy of regulatory authority, while EFAA emphasizes the legal limits placed on its exercise. The judgment contains both.

12. What this means going forward

The FFAR are unlikely to disappear for the time being, due to the importance of agents to the football transfer system. The more likely outcome is regulatory reconstruction.

The provisions most likely to require amendment are:

• the two-month approach restriction;

• Article 19 publication obligations;

• parts of the licensing eligibility framework;

• aspects of multiple-representation restrictions;

• the service-fee structure and USD 200,000 threshold; and

• procedural safeguards surrounding FIFA’s supervisory powers.

The fee cap may survive, but FIFA will need evidence explaining the percentages, threshold and global applicability. The licensing system will likely survive, but exclusions may need to be more targeted, time-limited and subject to individual assessment. Conflict-of-interest rules will likely survive, but a more nuanced model may replace blanket prohibitions.

FIFA’s collection of regulatory data will likely continue, but public disclosure will need to be sharply reduced.

The approach rule appears the most immediately vulnerable competition provision.

The larger institutional change is equally important. Although the CJEU judgments apply within the EU legal order, their implications are unlikely to remain confined to Europe.

Discussions on future agent regulation will be increasingly difficult to impose unilaterally, and the judgments strengthen the case for a structured process involving FIFA, agent organizations, players, clubs, leagues, and member associations. As professional football continues to grow at scale in regions outside Europe, similar questions are likely to emerge concerning competition, market access, proportionality, data protection, and the legitimacy of globally uniform rules across materially different legal and commercial environments.

Conclusion

The CJEU has not removed FIFA’s authority over football agents.

It has converted that authority from broadly asserted sporting autonomy into legally reviewable regulatory power.

The future FFAR framework must satisfy four separate legal disciplines:

• Article 101 TFEU;

• Article 102 TFEU;

• freedom to provide services; and

• the GDPR.

The decisive question is no longer whether FIFA may regulate agents.

It is whether each restriction is supported by evidence, directed at a genuine risk, proportionate in design and fair in its market effects.

To mark this milestone, I wanted to keep a promise.

In Part II, we moved into the Diarra ruling itself and FIFA’s immediate response: the Interim Regulatory Framework, the recalibration of Article 17, the shift away from automatic assumptions around joint liability, and the importance of the International Transfer Certificate in protecting player mobility.

Part III now turns to the real question.

Not whether the FIFA transfer system survived.

The system survived — now it must be refined

When the Diarra ruling was issued, many interpreted it as the beginning of the end for the FIFA transfer system.

That was not the outcome.

The RSTP remains in force. Transfers continue. FIFA’s regulatory authority was not erased. Contractual stability was not abandoned. The Football Tribunal remains active. The ITC process remains central to the registration process.

But mere survival is not the same thing as completion.

That is why the next phase matters.

The issue is no longer whether FIFA can regulate the transfer system. The issue is whether the system can be refined in a way that gives clubs, players, agents, lawyers, member associations, and tribunals a clearer method for applying the rules in practice.

What did not change

This is the point often missed in public discussion.

Contractual stability remains. The protected period remains. Compensation for breach of contract remains. Compensation clauses remain relevant. The ITC framework remains intact. Training rewards, solidarity, the protection of minors, and sporting sanctions remain part of the regulatory framework. What changed is not the existence of these principles, but the way certain consequences must now be justified, evidenced, and applied.

That distinction is important.

The system has not moved from regulation to deregulation. It has moved from presumption to proof.

Compensation remains the central problem

Article 17 remains one of the most difficult provisions in football law because it sits at the intersection of contractual stability, player mobility, club investment, and legal certainty.

Before Diarra, compensation calculations could rely on established formulas and assumptions.

After Diarra, the damaged party must do more than claim loss. It must request, prove, and demonstrate how it reached the amount claimed. The question becomes: what are the damages, how were they calculated, and how do they place the damaged party in the position it would have been in had the contract been performed in its entirety?

That is a more legally disciplined approach.

But it also creates a new problem.

That is the challenge for FIFA. Positive interest remains the legal reference point, but the football industry still needs a compensation model that parties can understand before a dispute begins — not only after proceedings have already started.

Contract drafting now matters more

One practical consequence is clear: contract drafting will become more important than it already is.

If compensation can no longer be assumed through automatic formulas, the parties may increasingly need to define the consequences of breach in the contract itself. Liquidated damages clauses may become more central, provided they are drafted carefully and assessed through the lens of reciprocity, proportionality, and applicable regulatory principles.

This matters for clubs, agents, players, and lawyers.

A poorly drafted contract creates contractual uncertainty. An excessive clause may be challenged. A one-sided clause may raise issues of proportionality.

But a properly drafted clause can give the parties a clearer understanding of risk before the relationship breaks down.

It is regulatory risk management.

Joint liability still needs calibration

The end of automatic joint liability is one of the most important practical consequences of the post-Diarra framework.

Previously, a new club could be treated as jointly and severally liable because the player registered with that club after the breach. That approach is no longer sufficient. Joint liability must now be requested, demonstrated, and substantiated. It is not enough to identify the new club and assume inducement. Evidence matters: documents, dates, communications, public information, and a clear narrative showing how the new club allegedly induced the breach.

That is a necessary correction.

But FIFA may still need to clarify the evidentiary threshold. If the burden becomes too low, the old presumption returns through the back door. If the burden becomes too high, former clubs may struggle to prove genuine inducement even where improper conduct occurred.

This is the calibration problem.

Sporting sanctions remain unresolved

Sporting sanctions also remain part of the system, but their application is now more sensitive.

The issue is not simply whether sanctions exist. They do. The harder question is when they should apply, how consistently they should be imposed, and whether FIFA should be stricter with repeat offenders.

This matters because sporting sanctions are not ordinary contractual remedies. They affect registration, competition, squad planning, player careers, and club operations. They also carry regulatory consequences beyond compensation.

If sanctions are applied too automatically, they risk becoming disproportionate. If they are applied too rarely, contractual stability may lose practical force.

That tension and imbalance has yet to be fully resolved.

ITC reform must account for global administrative capacity

The ITC system is another example of why the post-Diarra debate cannot be viewed exclusively through a European lens.

The 72-hour deadline protects player mobility. It prevents unresolved contractual disputes from being used to block registration. That is important.

But member associations have raised practical concerns. Some member associations may not be fully connected to FIFA systems. Weekends may compress the actual response time in certain instances. Therefore, a 72-hour period may be workable for larger, better-resourced federations, but more difficult for associations with limited administrative capacity. One possible reform discussed was extending the deadline to five days.

This is where the global nature of the transfer system becomes real.

A rule can be legally correct and still be difficult to administer evenly across 211 member associations.

The CONCACAF implication

If the future RSTP becomes more evidence-heavy, procedurally disciplined, and technically precise, then regions without strong domestic football dispute systems will face a structural disadvantage.

Clubs will need standarized contract management. Players will need clearer legal guidance before terminating contracts. Agents will need to understand the line between representation and inducement. Member associations will need reliable registration and EPP systems. Arbitration bodies will need football-specific expertise. Domestic dispute resolution systems will need to understand FIFA concepts such as contractual stability, protected periods, just cause, positive interest, joint liability, ITCs, and sporting sanctions.

Without that infrastructure, stakeholders in developing football markets will not merely be behind the law.

They will be unable to use the system properly.

That is why Diarra also matters beyond Europe.

It is not only a European labour mobility case. It is a regulatory stress test for the entire global transfer system.

Closing thought

Diarra did not end the transfer system.

It exposed the work still required to make that system more precise, more evidence-based, and more administratively workable.

The next phase of FIFA reform will not be judged only by the wording of the next RSTP. It will be judged by whether clubs, players, agents, lawyers, member associations, and arbitration bodies can actually apply it in practice.

That is the real post-Diarra question.

Not whether the system survived.

Whether it can now be refined.

But unlike in Europe—where player associations and FIFPro itself have already shown solidarity and begun engaging with the issue—there has been no clear, coordinated response in Canada.

This includes:

• PFA Canada — a FIFPro member positioned to serve players within the domestic ecosystem (Canadian Premier League and Northern Super League), yet operating without a collective bargaining framework and without a visible position on integrating Canadian players into the Justice for Players process

• The Canadian Soccer Players Association, where I previously served as a legal advisor during national team CBA negotiations—an important step forward— But in the absence of any action to align the Canadian voice with Justice for Players, there is a clear gap in how Canadian stakeholders are informed

The result is a structural gap:

Over the past five years, FIFA has undergone a structural transformation toward regulatory transparency.

The publication of Football Tribunal jurisprudence, the CAS & Football Annual Report, the Global Transfer Report, and Clearing House distributions has materially reduced informational asymmetry at the global level.

The system is no longer opaque.

But transparency has not translated into application.

Across CONCACAF—and more acutely in Canada, where we are based—there remains a measurable gap between access to the global regulatory system and the ability to operate within it.

This gap is not theoretical. It produces real legal, economic, and institutional consequences that will be analyzed below.

This article builds on a body of work developed through Pitchside Sports Consulting over the past year — where these findings were formalized and presented to stakeholders including the Caribbean Football Union, FIFA and different Member Associations, CONCACAF, law firms, and arbitration centres.

These findings establish an analytical framework for assessing regulatory alignment in CONCACAF—and Canada in particular—demonstrating how global regulatory systems remain under-utilized and systemically misunderstood at the domestic and regional level.

Across this work, one conclusion has remained consistent:

The issue is not access.

It is execution.

I. Legal Participation Gap — Absence from the FIFA/CAS System

(FIFA decisions vs CAS appeals vs CONCACAF participation vs Canada Soccer Regulatory absence)

Analysis of FIFA Football Tribunal reports, decisions, and commentaries—together with CAS awards—reveals a clear structural asymmetry:

• FIFA issues tens of thousands of decisions annually, exceeding 30,000 across its judicial bodies

• Fewer than 1% are escalated to CAS (e.g., 346)

• Approximately 4.6% of cases involve CONCACAF stakeholders

• When excluding the United States and Mexico, participation drops to near-zero levels

This is not a reflection of fewer disputes within the region.

It is a failure to access jurisdiction.

As highlighted in the CAS & Football Annual reporting, the data demonstrates a consistent pattern: clubs, players, and agents across CONCACAF are largely absent from the formal dispute resolution mechanisms that govern the global game.

The system is active.

The region is not.

Technical Interpretation

This absence reflects systemic execution gaps:

• Jurisdiction is not triggered
  Claims are not structured under FIFA RSTP frameworks (e.g., Article 14, Annex 3, training compensation)

• Procedural inadmissibility
  Cases are:

  • filed domestically without recognized NDRCs

  • rejected for lack of international dimension

  • abandoned due to procedural complexity

• Contracts lack enforceability
  Missing:

  • jurisdiction clauses aligned with FIFA-CAS

  • enforceable payment structures with other clubs

  • evidentiary foresight for disputes

System Consequences

• Jurisprudence develops without meaningful input from CONCACAF Member Associations, including Canada Soccer

• Legal doctrine becomes geographically concentrated in more active jurisdictions (e.g., Europe, South America, Africa, Asia)

• Domestic arbitration systems remain jurisdictionally disconnected from the FIFA framework (e.g., Sport Dispute Resolution Centre of Canada)

Key Insight

This is not simply a statistical imbalance.

It reflects a structural absence of participation by:

• The Canadian Premier League and The Northen Super League clubs that are not asserting contractual rights at FIFA

• Players who are not accessing dispute mechanisms, despite two active players associations with a mandate to protect Canadian player interests

• Agents who are not enforcing regulatory entitlements due to lack of any clear recourse in the Canadian soccer ecosystem

In effect, a region comprising 41 Member Associations is operating largely outside the system that governs the global football economy.

II. Economic Gap — Failure to Capture Regulatory Value

(Global transfer value → FIFA Clearing House redistribution → CONCACAF leakage)

The legal gap produces a direct economic consequence.

Global data shows:

• 24,558 international transfers (2025)

• $13.08 billion USD in transfer spend

• Hundreds of millions redistributed annually through FIFA mechanisms

Yet:

• Less than 3% of distributions involve CONCACAF

• Canadian participation remains effectively absent

Technical Interpretation

This is not a participation issue. It is a regulatory monetization failure.

Training compensation and solidarity through the FIFA Clearing House are:

• automatic

• non-negotiable

• legally enforceable

Failure to capture these revenues reflects:

• incomplete or misaligned player registration systems

• lack of alignment at federation or league level with TMS and EPP frameworks

• missed claim timelines exceeding the two year window

• absence of enforcement infrastructure

Macroeconomic Impact

• Clubs operate under artificial financial constraint

• Development pathways for the next generation remain underdeveloped and over-funded

• Pay-to-play models persist

This is not structural.

It is the systemic result of non-application of existing rules.

III. Capacity Gap — The Root Cause

(Education / Institutional / Professional breakdown)

The legal and economic gaps are downstream effects.

Across the region:

• There is no structured pathway to develop football regulatory expertise or become an international sports lawyer

• Stakeholders lack applied understanding of FIFA frameworks

Three Layers of Failure

1. Educational

In universities, North American legal frameworks largely exclude:

• FIFA RSTP

• Football Tribunal procedure

• CAS litigation strategy

2. Institutional

• No FIFA-recognized NDRC in Canada

• Limited integration with global dispute systems

• Lack of football-specific adjudication expertise

3. Professional Practice

• Legal advisors do not consistently integrate FIFA regulatory frameworks into their work

• Disputes are approached primarily through domestic legal paradigms

• Transactions are not structured for international enforceability under FIFA systems

It is important to note that sports law practices do exist within Canada, including firms that operate under that designation.

However, the distinction is not in name—but in scope.

At Pitchside Sports Consulting, following a number of ongoing engagements with law firms in the domestic market, a consistent theme has emerged:

What remains largely absent, from their own accounts, is a specialized integration of:

• FIFA RSTP application

• Football Tribunal procedures

• CAS litigation strategy

• cross-border regulatory enforcement

While they acknowledge our niche practice in soccer, this gap creates a structural shortcoming between:

• sports law as practiced domestically, and

• football regulatory expertise as required by the global system

Until that distinction is operationalized within professional practice, legal advisory in this space will remain partially disconnected from the mechanisms intended to govern international football.

IV. Systemic Interaction — A Closed Loop Failure

These gaps reinforce each other:

Capacity deficit
→ Legal non-participation
→ Economic loss
→ Reduced investment in expertise
→ Persistent capacity deficit

This is not fragmentation.

It is a self-reinforcing system failure.

V. Strategic Implications

For Law Firms

A clear advisory gap exists in:

• FIFA-compliant contract structuring

• cross-border dispute management

• Clearing House monetization

This is not niche.

It is an unbuilt practice area tied to a multi-billion-dollar system.

For Arbitration Centres

The opportunity is structural:

• Align with FIFA NDRC Recognition Principles to establish recognized first-instance jurisdiction

• Integrate into the global dispute resolution system, linking domestic proceedings with the FIFA Football Tribunal and CAS

• Enhance jurisdictional relevance and caseload quality by becoming an operational node within the international framework

This shifts arbitration centres from peripheral forums to recognized components of the global football dispute ecosystem.

For Leagues, Federations and Regional Leadership

The issue is not regulatory design. It is regulatory implementation.

As the former lawyer to the World Leagues Association, I worked across the core components of successful football systems: standardization, oversight, and economic redistribution.

This included exposure to leading leagues such as the English Premier League, LaLiga, the South African Premier Soccer League, J-League, K-League, and A-League, as well as coordination with FIFA and its Member Associations.

One principle was consistent:

Effective football governance is not defined by regulation alone, but by how those regulations are implemented through structured stakeholder alignment.

Collective dialogue between federations, leagues, clubs, players, and intermediaries is not supplementary—it is foundational.

This is directly relevant to Canada.

With Canada Soccer, the Canadian Premier League, and the Northern Super League already connected to international stakeholder networks, the foundation exists.

The opportunity now is functional integration within the global regulatory system.

For Clubs and Player Development

The current system produces:

• Underfunded development structures due to uncaptured regulatory entitlements

• Reliance on pay-to-play models, shifting cost from system to participant

• Reduced competitive integrity, with talent pathways influenced by access rather than merit

Correct application of FIFA frameworks would:

• Unlock embedded revenue streams (training compensation and solidarity)

• Incentivize long-term player development through enforceable financial returns

• Reinforce merit-based progression, aligning domestic pathways with global standards

This is not a question of resources.

It is a question of regulatory execution and value capture.

VI. From Analysis to Application — Priority Areas

If the objective is to operationalize football regulatory affairs and compliance within Canada, the starting point is not incremental reform.

It is targeted implementation.

At the Football Regulatory Database, we believe three priority areas emerge:

1. Electronic Player Passports (EPP)

System-wide adoption ensures:

• Accurate tracking of player registration history through standardized Electronic Player Passports (EPPs)

• Compliance with FIFA Clearing House requirements, including validated player registration data for training rewards

• Automatic activation of training compensation and solidarity mechanisms

This also requires effective compliance checks at the Member Association level—and, where applicable, at the league level in centralized systems (e.g., MLS)—to ensure data integrity and proper identification of entitled clubs.

This is not simply a data exercise.

It is the operational backbone of FIFA’s financial redistribution framework.

2. Integrated Dispute Resolution Framework

A centralized sport dispute resolution structure would:

• protect players, clubs, agents and investors under one system

• ensure procedural efficiency

• align with FIFA and international sports law jurisdiction

Disputes in football require resolution in days, not months or years — this is why a sport specific body is key to development.

3. FIFA-Aligned National Framework (MA RSTP + NDRC)

Establishing a recognized domestic transfer regulatory framework would:

• provide first-instance jurisdiction domestically

• ensure international enforceability

• protect contractual stability in disputes lacking an international dimension

It would also:

• support agent regulation

• clarify development pathways

• align stakeholders across the system

Conclusion — From Execution to Alignment

The global football regulatory system is functioning.

The issue is regional execution.

For CONCACAF—and for Canada—the next phase is not awareness.

It is application.

Football regulatory expertise is the mechanism through which:

• disputes are resolved

• rights are enforced

• economic value is captured

• systems are aligned

Final Positioning

The work developed through Pitchside Sports Consulting and the Football Regulatory Database has followed a consistent trajectory:

Identify → Define → Quantify → Apply

This article reflects that progression.

Not as commentary.

But as applied infrastructure.

The frameworks exist.
The solutions are known.

The remaining step is alignment.

Final Line

At this stage, the question is no longer what needs to be done—but who is prepared to execute it.

Canadian Soccer Media & Entertainment’s (formerly Canada Soccer Business) acquisition of NWSL media rights has been positioned as a progressive step for the Canadian game. It expands access, enhances visibility for Canadian players, and strengthens the year-round opportunities of elite women’s football in the regional CONCACAF market.

All of that is correct.

But it is incomplete without understanding where this was truly built from.

Because this is not the emergence of an innovative strategy. It is the delayed execution of one that had already been identified, structured, and supported years earlier.

This Did Not Start With a Broadcast Deal

In 2020, while I was serving as a legal advisor to the Canadian Soccer Players Association, a formal business case was developed to bring an NWSL club directly into the Toronto and Canadian soccer ecosystem. This work was carried out on behalf of the Canadian Soccer Players Association, at a time when the structural gap in Canadian women’s football was already well understood.

I was part of that process—contributing to a feasibility project that moved beyond concept and into design.

The Market Was Already Proven

The 2020 business case did not need to speculate about viability.

It demonstrated it.

The proposal was not exploratory. It was directional.

Further, the analysis was grounded in broader macro trends shaping women’s football globally.

In other words, the window of opportunity was already open.

Toronto Was Strategically Positioned

The business case also made a second point that remains unchanged today: Toronto is not just a viable market—it is a strategically optimal one.

It also situates football within a broader global context, emphasizing that the sport’s scale and relevance were already far beyond what the Canadian domestic structure reflected at the time.

The conclusion was straightforward:

The Original Model: Build the System

The 2020 proposal did not treat the NWSL as content to be licensed.

It treated it as a structure to be embedded.

The objective was to establish a professional club that would anchor elite women’s football in Canada—creating continuity between national team success and domestic engagement, while building a commercially viable ecosystem around it.

The initiative brought together stakeholders with legal, commercial, and football expertise, including Davies Ward Phillips & Vineberg and the Boston Consulting Group.

This was a credible, multidisciplinary effort aimed at execution—not just advocacy.

A Six-Year Delay

The most important question is not whether this strategy was correct.

It is why it took six years for any part of it to materialize.

The 2020 plan was designed for near-term implementation. It identified the problem, validated the market, and outlined a pathway forward.

Yet between 2020 and 2026:

• no NWSL club was established in Canada;

• governance concerns surrounding Canada Soccer intensified;

• no integrated domestic professional ecosystem was operationalized at scale; and

• no coherent media strategy consistently connected Canadian players to Canadian audiences.
